1. Who we are
This site is operated by Cream Chargers Canada, 93 Front St E, Toronto, ON M5E 1C3. Email support@creamchargerscanada.com.
2. Eligibility
You must be 18 or over to buy from us, and you confirm at checkout that the goods are for the preparation of food and drink. We may verify age and intended use before dispatch and may cancel any order we believe breaches this (see our age policy and legal guidance).
3. Products and culinary use
Everything we sell is food-grade nitrous oxide, or equipment for using it, supplied strictly for culinary use. You agree not to use, or supply to anyone else for, inhalation or any purpose other than preparing food and drink. Product descriptions and purity figures are provided by the manufacturers named on each page.
4. Orders and contract
An order is an offer to buy. We accept it when we dispatch the goods; until then we may decline it, including where stock is unavailable, the price was obviously wrong, or verification fails. Any payment already made for a declined order is refunded in full.
5. Prices and payment
Prices are in Canadian dollars and exclude sales tax, which is added at checkout according to the delivery address. Payment is by Interac e-Transfer, or cash on delivery where offered for bulk orders (see payment methods). Orders are held until payment is received. A minimum order of $175 applies.
6. Delivery
We deliver within Canada only, by tracked courier, on the terms set out on our delivery page. Delivery estimates are estimates. Risk in the goods passes to you on delivery; title passes when we receive payment in full.
7. Returns, cancellations and refunds
Our returns policy applies. Opened or part-used pressurised goods cannot be returned except where faulty. Your statutory rights under the consumer protection legislation of your province or territory are not affected by these terms.
8. Safety
You are responsible for storing and using the goods in line with the manufacturer’s instructions and our safety guidance. Cylinders must be kept upright, below 50 °C, away from heat and out of reach of children, and used only with compatible equipment.
9. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence. Subject to that, we are not liable for loss arising from misuse of the goods, from use contrary to the manufacturer’s instructions or our guidance, or for indirect or consequential loss, and our total liability in connection with an order is limited to the price paid for it.
10. Trade customers
Trade accounts are verified before first dispatch. Pallet pricing, payment terms and scheduled deliveries are as agreed in writing for each account; where they differ from these terms, the written agreement prevails.
11. Privacy
We handle personal information as described in our privacy policy.
12. Governing law
These terms are governed by the laws of ON and the federal laws of Canada applicable there. Consumers keep the protections of the law of the province or territory where they live.
13. Changes
We may update these terms; the version on this page at the time you order applies to that order.
